GENERAL WAIVER AND RELEASE WARNING: This agreement is legally binding. If any aspect of this agreement requires clarification, please have an ETTV AMERICA, CORP/Super TV USA., employee fully explain before signing. In signing this document, you are waiving the right to bring a court action to recover compensation or obtain any other remedy for any personal injuries, damage to property, accident of any kind, or for your death, arising out of your participation. All participants must sign. Parents of minors must sign for contestants. I, _________________________________, as RELEASOR, hereby, agree to release, indemnify and hold harmless all persons at the 2012 ETTV TOP IDOL, as RELEASEE, including all officers, agents, sponsors, employees, volunteer assistants, other contestants, visitors, or persons who may be present, from any cause of action, claims, or demands whatsoever. This agreement is binding even if the released persons have contributed to my injuries through their individual or collective negligence. This agreement is binding on myself, my heirs, next of kin, assigns, and personal representatives. IN CONSIDERATION of my involvement at the event named above I acknowledge and agree that:(1) I hereby consent to the photographing of myself and the recording of my voice and the use of these photographs and/or recordings singularly or in conjunction with other photographs and/or recordings for all event or partners’/sponsors’ advertising, publicity, commercial or other business purposes. I understand that the term "photograph" as used herein encompasses both still photographs and motion picture footage. I further consent to the reproduction and/or authorization to reproduce and use said photographs and recordings of my voice, for use in all domestic and foreign markets. (2) I risk bodily injury, including paralysis, dismemberment, disability and death, and while particular rules of my performance, equipment, personal training and discipline may reduce this risk, the risk of injury does exist, as well as the risk of damage to or loss of property; (3) I knowingly and freely assume all such risks, both known and unknown, even if arising from negligence of the RELEASEE or others; (4) I willingly agree to comply with the stated and customary terms and conditions for participation. FOR PARTIPANTS OF MINOR (AGE UNDER 18): This is to certify that, as parent or guardian with legal responsibility for this participant, I do consent not only to his/her release, but also for myself/ourselves, and my/our heirs, assigns and next of kin, to release and indemnify the RELEASEE from any and all liability incident to my/our minor child's involvement as stated above. I have read this Release of Liability and Waiver Agreement, fully understand its terms and sign it freely and voluntarily.
