YOU MUST BE AT LEAST 14 YEARS OLD AND A LEGAL RESIDENT OF AND CURRENTLY RESIDING IN THE 50 UNITED STATES OR WASHINGTON D.C. SUBMITTING YOUR ENTRY INTO THIS CONTEST CONSTITUTES YOUR ACCEPTANCE OF THESE RULES AND REGULATIONS.

2012 ETTV Top Idol Talent Search Contest

RULES AND REGULATIONS


  1. CONTEST: The 2012 ETTV Top Idol talent search contest (the "Contest") is a singing contest designed to discover potential pop stars of tomorrow. The Grand Prize includes a two-year free lease of a 2012 MINI Cooper Hardtop automobile ("Prize Vehicle"). The Contest will be broadcast on ETTV America and Super TV 62.6.

  2. SPONSORS: The Contest is sponsored by ETTV America Corp., 18430 E. San Jose Ave. #A, City of Industry, CA 91748 and Autoworld Magazine, 8808 Mission Dr. Suite 109, Rosemead, CA 91770 ("Sponsors").

  3. CONTEST PERIOD: The Contest begins on June 1, 2012 at 6:00:00 A.M. Pacific Standard Time (PST) Zone in the United States and ends on September 8, 2012 at 11:59:59 P.M. PST ("Contest Period"). All dates are subject to change.

  4. ELIGIBILITY: To be eligible to enter the Contest, a contestant ("Contestant" or "You") must be at least 14 years old and a U.S. citizen or permanent U.S. legal resident. You must have the written consent of a parent or legal guardian and have him or her to accompany you through the Contest in order to be eligible to enter the Contest and receive any prize if you are under the age of 14. Employees, interns, and contractors of the Sponsors, and their parent company, subsidiaries, affiliates, and their respective directors, officers, advertising and promotion agencies, representatives, and agents, and their immediate families (parents, siblings, children, spouses, domestic partners) and members of the households of such employees, officers and directors are not eligible to participate in the Contest. Winners from previous years’ contests are not eligible to enter. The Contest is valid in the 50 United States and Washington D.C. only. Void where prohibited.

  5. PRIZES: The 2012 ETTV Top Idol grand prize winner ("Champion") will be awarded cash $1,500 and a two-year free lease ("Lease") of a 2012 MINI Cooper Hardtop with other gifts; the second place winner will be awarded cash $1,000 with other gifts; the third place winner will be awarded cash $500 with other gifts.

    In order to obtain the Lease of the Prize Vehicle, the Champion must be at least 18 years old, have a valid driver’s license, provide proof of insurance, and maintain insurance on the Prize Vehicle for the term of the 2-year lease. If the Champion cannot obtain the lease because of the lack of the foregoing conditions, he or she may transfer his or her right to the Lease to a third person ("Transferee") who meets all the foregoing conditions and consent all the Rules and Regulations related to the Prize Vehicle. The Prize Vehicle cannot be subleased unless it is agreed by the Sponsors. The Champion or Transferee is required to execute all application documents to obtain approval for the Lease from MINI of Monrovia or third party leasing company and execute a 2-year lease agreement. Autoworld Magazine will pay the monthly rental fees for the 2-year lease under Champion's name.

    Vehicle color, trim level, and other Vehicle options and equipment are "as is" and cannot be changed. Prize Vehicle cannot be exchanged for any cash value option, and must be picked up by the winner within 30 days after the Champion is announced.

  6. TAXES: TO THE EXTENT PERMITTED BY LAW, ALL TAXES, WHETHER LOCAL, STATE, FEDERAL, OR INTERNATIONAL, IMPOSED ON PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNERS. GRAND PRIZE WINNER IS SOLELY RESPONSIBLE FOR ALL THE EXPENSES RELATED TO THE PRIZE VEHICLE AND ANY DELIVERY/FREIGHT/PICKUP CHARGES RELATED TO ITS DELIVERY TO WINNER’S RESIDENT, INCLUDING BUT NOT LIMITED TO: FEES FOR INSURANCE, TAX, AND FUEL. THE GRAND PRIZE WINNER IS NOT RESPONSIBLE FOR THE COST OF THE PRIZE VECHILE AND RENTAL FEES FOR THE 2-YEAR PERIOD OF LEASE.

    ALL WINNTERS EXPRESSLY AGREE TO SUBMIT TO THE SPONSORS, A REPRESENTAIVE FOR SPONSORS OR THE RELEVANT TAX AUTHORITY, ALL TAX DOCUMENTATION REQUIRED BY THE SPONSORS OR OTHERWISE REQUIRED BY APPLICABLE LAW TO PERMIT THE SPONSORS TO COMPLY WITH ALL APPLIABLE LOCAL, STATE, FEDERAL, AND INTERNATIONAL TAX REPORTING. ALL PRIZES WILL BE NET OF ANY TAXES THE SPONSORS ARE REQUIRED BY LAW TO WITHHOLD. If the winner is under the age of 18, his or her parents or legal guardians are responsible for ensuring that they comply with all the applicable tax laws and filing requirements. If a potential winner fails to provide such documentation or comply with such laws, the prize may be forfeited and the Sponsors may, in its sole discretion, select an alternate potential winner.

  7. GENERAL CONDITIONS: Sponsor reserves the right, in its sole discretion, to disqualify and eliminate any Contestant from the Contest it reasonably believes that the Contestant has be acting in violation of these Rules, or has attempted to undermine the legitimate operation and integrity of the Contest by cheating, deception, or other unfair playing practices or annoys, abuses, threatens or harasses any other Contestants, Sponsor, or the Judges. Sponsor reserves the right to terminate the Contest if fraud, misconduct, or technical failures have undermined the integrity of the Contest, or for any other reason deemed reasonable by Sponsor.

  8. LIMITATION OF LIABILITY: All Contestants agree to release and hold harmless Sponsors and all of its respected affiliated companies and all of their respective directors, officers, employees, agents, legal counsel, and participating promotional partners from all losses, damages, penalties, claims, action, suits, cost, and expenses of any kind whatsoever and any property damage, personal injury, or death to any participant or third person caused by or arising out of or in connection with participation in the Contest or with use of any prizes awarded. Sponsor is not responsible for any incorrect or inaccurate information and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communication line failure, theft or destruction, or unauthorized access to the Contest. All Contestants must agree and sign the General Waiver and Release Agreement attached herein to be eligible to enter in the Contest.

  9. DISPUTE: As a condition to participating in the Contest, Contestants agree that any all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Event, shall be resolved individually, without resort to any form of class action, exclusively, before a court located in Los Angeles, California having competent jurisdiction, which Court shall apply the laws of the State of California without regard for the doctrines of Conflict of Law. Further, in any such dispute, under no circumstances will Contestants be permitted to obtain awards for, and each hereby waves all right to claim punitive, incidental, or Attorney fees.

  10. BINDING AGREEMENT: In order to enter the Contest, you must agree to the Rules and Regulations. You agree that enter in the Contest constitutes agreement to these Rules and Regulations. These Rules form a binding legal agreement between you and the Sponsors with respect to the Contest. All federal, state and local laws and regulations apply. Sponsors reserve the right to change these Rules and Regulations at any time as it determines necessary in its sole discretion.

  11. SEVERABILITY: If any part of this Rules and Regulations is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect as nearly as possible, the original intention of the Rules and Regulations, and the remaining portions shall remain in full force and effect.
